Subject: Requesting a Special Use Permit to allow a commercial communication tower to exceed the maximum height permitted in the O-S zoning district.
Decision: Approved with the following conditions:
1. Compliance with the site plan dated October 8, 2009 submitted for AZPHX0537D, East Medical Monopalm for 7525 E. Broadway Road except as modified by the conditions below.
2. The monopalm shall have a maximum height of sixty (60’) at the top of the proposed monopalm.
3. The antennas shall not exceed 4’-4” in length, 1’-2” in width, and 4” in depth.
4. The antennas shall be painted to match the color of the fronds.
5. The antenna standoff assembly shall not extend more than 8” from the pole.
6. The 6’ high CMU screen wall shall match the existing CMU in color, texture and crown.
7. Compliance with all requirements of the Building Safety Division with regard to the issuance of building permits.
Summary: Rulon Anderson represented the case for Clearwire. Mr. Gendron asked Mr. Anderson if he wished to comment on the case. Ms Guevara explained that staff had worked with the applicant and had come to an agreement on a revised site plan and revised conditions of approval. Mr. Gendron approved the case based upon the staff report and recommendation.
Finding of Fact:
1.1 The Special Use Permit case# ZA09-41 was continued to the October 13, 2009 hearing at the October 6, 2009 hearing. The applicant revised the site plan to relocate the ground equipment cabinet behind the trash enclosure. Staff approves the new location and screening device.
1.2 The requested Special Use Permit (SUP) will allow the placement of a 60-foot high monopalm in an existing office development located at 7525 E. Broadway in O-S zoning district.
1.3 The applicant notified all property owners within 300-feet of the request and no comments or concerns were received.
1.4 The monopalm is 60-feet high and the array will consist of three sectors, with three antennas, three daps, and three microwave dishes. The antennas will be 4’ 2” in length, 1’ 1” wide, and 4” deep. A condition of approval has been added requiring the antennas be painted to match the color of the frond.
1.5 The project will also include an equipment cabinet that will be screened by the existing 6’ high CMU wall for the trash enclosure. The drawing shows a new screen wall 3’-3” long and 6’ high proposed between trash enclosure and existing AT&T ground equipment screen wall to the south.
1.6 The monopalm will be built to allow a minimum of one carrier. The applicant has noted that there is an existing 65’ high monopalm just 40 feet south of this location within the site. However it does not provide the ability to collocate because there is no more space to hide additional antennas within the existing palm fronds.
1.7 The monopole complies with the Commercial Communications Towers Guidelines in that it is more than 200-feet from the right-of-way, where only 80-feet would be required. In addition, the monopalm is approximately 184-feet from the R1-6 zoning district to the west and approximately 219-feet from the adjacent R1-6 zoning district to the north.
1.8 The monopalm is located within an office zone, as a result, the monopalm will be compatible, and not detrimental to the R1-6 zoning district to the north.

Subject: Requesting a Special Use Permit to allow a commercial communication tower to exceed the maximum height permitted in the M-1 zoning district.
Decision: Approved with the following conditions:
1. Compliance with the revised site plan dated 10/8/2009 except as modified by the conditions below.
2. The monopole shall have a maximum height of eighty (80”) at the top of the pole and top of the antennas.
3. The antennas shall not exceed 4’-4” in length, 1’-2” in width, and 4” in depth.
4. The antennas shall be painted to match the color of the monopole.
5. The wrought iron gate and metal backing shall be painted to match the screen wall.
6. The antenna standoff assembly shall not extend more than 8” from the pole.
7. Compliance with all requirements of the Building Safety Division with regard to the issuance of building permits
Summary: Ms. Guevara explained that staff and Mr. Anderson were able to reach an agreement with the revised site plan and revised conditions of approval. Mr. Anderson agreed and accepted the conditions. Mr. Gendron approved the case based on the staff report and recommendation.

1.2 The applicant noticed all property owners with 300-feet of the request and no comments or concerns have been received.
1.3 The monopole is 80-feet high and will have an array that consists of three sectors, with three antennas, three daps, and three microwave dishes. The antennas will be 4’ 2” in length, 1’ 1” wide, and 4” deep. A condition of approval has been added requiring the antennas be painted to match the color of the monopole.
1.4 The project will include an equipment cabinet that will be screened with an 8’ high screen wall. The elevation drawing shows a wrought iron gate with metal backing. The gate will be painted to match the screen wall as a condition of approval.
1.5 The monopole will be built to allow a minimum of two carriers and a maximum of three carriers. The applicant noted that there is an existing monopole south of this site with three existing carriers and the monopole is not structurally sound to handle any additional carriers.
1.6 The monopole complies with the Commercial Communications Towers Guidelines in that it will be approximately 140-feet from the right-of-way, where only 80-feet would be required. In addition, the monopole will be approximately 45-feet from the adjacent industrial zoned property to the west and approximately 165-feet from the adjacent industrial zoned property to the east.
1.7 The communication tower and equipment lease area are within the front half of the site within the parking area. It will eliminate three or four existing parking spaces. Existing building permit records show that the site was originally developed with 24 excess parking spaces at the site.
1.8 The monopole is located within an industrial zone, as a result, the monopole will be compatible with, and not detrimental to, adjacent properties or the neighborhood in general.
There being no further business to come before the Zoning Administrator, the hearing adjourned at 1:34 p.m.
